Ex-Unitech promoters in SC seeks hearing on bail pleas in fraud case
Former Unitech promoters Sanjay Chandra and Ajay Chandra on Wednesday urged the Supreme Court that either their bail pleas be heard by it or they be allowed to move the trial court for securing relief in a financial fraud case in which they are in custody for over five years. During the hearing, the top court asked the Noida authority to process the layout and building plans of Unitech Group, without asking for the upfront payment of dues. A bench of Chief Justice D Y Chandrachud and Justice M R Shah was told by senior advocate Siddharth Dave, appearing for Chandra brothers, that both of them are lodged in jail for over five years and six months in the case lodged by Economic Offences Wing (EOW) of Delhi Police for financial fraud for which maximum sentence is seven years imprisonment. The bench asked what happened to the precondition of deposition of Rs 750 crore in the court for securing bail. As per info available with new Mgmt, Unitech Limited(UL) availed Vendors' Bill Discounting Facility from IDBI Bank for an amt of Rs. 395 Cr., which was converted into Term Loan on 10.02.2016 vide IDBI Bank's letter No. IDBI/ND/CBG-I/2015-16/1211, during the tenure of the erstwhile Mgmt which was superseded by the Hon'ble Supreme Court vide Order dtd 20.01.2020 & new BoD appointed. As per Bank's Statement dtd 07.04.2022, the total amt payable by UL to IDBI Bank is Rs. 937.66 Cr. on 31.03.2022. This overall liability is being reflected in financial st. for FY 21-22 which is being placed before Audit Committee of Company in its ensuing meeting on 14.02.2023. The liability on this account for the FY 20-21 (Rs. 797.37 Cr) was uploaded on the website of both BSE & NSE. Also, the Company has not recd. any information from CBI on the subject and is not able to provide any 'clarification' in terms of LODR Reg, 2015 at the moment.
