NCLT dismisses Rolta promoters' plea for one-time settlement

 The National Company Law Tribunal (NCLT) has dismissed a petition of the promoters of IT firm Rolta India Ltd seeking one-time settlement and regain the control of the company facing insolvency proceedings. In an order dated August 6, 2021, the tribunal rejected the Section 12 A plea of the promoters, Rolta said in a regulatory filing on Saturday. "... Stock Exchanges are further informed that on August 06, 2021, NCLT (pronounced orally in open court) has dismissed the applications filed under Section 12A of the Code at the instance of ex-management seeking withdrawal of the captioned petition post initiation of Corporate Insolvency Resolution Process (CIRP). Rolta India Ltd - 500366 - Order Dated May 31, 2021 Passed By The Hon'Ble National Company Law Appellate Tribunal In Company Appeal (AT) Number 384 Of 2021

 This is to inform Stock Exchanges that an Order dated May 13, 2021 (made available on May 25 2021) was passed by the Hon'ble National Company Law Tribunal (NCLT) allowing Company Petition No. 1069 of 2020 filed by Mr. Dinesh Gupta (ex-employee) and appointing Ms. Vandana Garg as an Interim Resolution Professional to conduct the Corporate Insolvency Resolution Process of the Company. In this regard, Company has filed Company Appeal No. 384 of 2021 before the Hon'ble National Company Law Appellate Tribunal (NCLAT) on May 28, 2021 praying for setting aside of the aforesaid Order. The Company has also settled with the ex-employee. Accordingly, Hon'ble NCLAT passed an Order dated May 31, 2021 staying the constitution of the Committee of Creditors until June 28, 2021 and has directed the Hon'ble NCLT to decide the withdrawal application when filed.
