Binani Industries Limited (BIL) had engaged various transporters for Binani Cement Limited (BCL) for providing logistics related services for BCL's cement operations and such services were directly rendered to BCL by these transporters. Because of temporary liquidity issues, BCL was admitted into Corporate Insolvency Resolution Process (CIRP) under IBC, 2016. The liability arising of such transport services were associated to BCL. However under the resolution plan, dues of the transporters engaged through BIL were not admitted by the RP. BIL being a related party the RP did not consider it eligible to receive payment under the resolution plan. Hence, the transporters are now demanding these payments from BIL who has not received any payment from the RP of BCL. Some of these vendors have already also preferred to file cases against BIL before the NCLT, Kolkata which are yet to be admitted and the same is pending before the Hon'ble NCLT. They have also filed cases under various provisions of law before other judicial fora and the matters are sub-judice. The vendors have suppressed the pendency of such cases while filing their complaint(s) against BIL and its Directors. BIL has sympathy for the transporters/vendors, who like BIL have been caught in the unfortunate series of events pursuant to BCL being admitted to CIRP. However the matters are sub-judice. The subjective liabilities are under dispute. The Company and its promoter Directors, stand committed to respect and honour any judicial decision in the pending matters.
